Estate Planning

What is Estate Planning?

Estate planning is the term for arranging and managing one’s property and assets so that they are distributed according to their wishes upon death or incapacity. What is an “estate”? Put simply, it’s everything that an individual owns – from homes to cars to life insurance and retirement accounts. That means estate planning is not just for the mega wealthy, like Warren Buffett or Elon Musk.

In fact, having an estate plan makes sense for nearly everyone.

And yet, according to various surveys, over half of Americans do not have basic estate planning documents in place. Do you feel like you are too busy for estate planning? Have you ever wanted to plan your estate but find it overwhelming and impersonal? Are uncertain fees or superstitions about death holding you back?

Our Process is About You

Barrett Legacy Estate Solutions is a bespoke Oklahoma estate planning law firm dedicated to creating customized estate plans.

Our process is simple:

  • Meet

We have a meeting in which our attorneys and staff hear about you and your family. After we have a basic understanding of what you are looking to accomplish, we quote a flat fee for our services.

  • Design

If you want to move forward, we design an estate plan tailored to your specific goals and circumstances. Our years of experience have taught us that no two families are alike. So, in this part of the process, we spend as much time as necessary to make sure the plan reflects who you are and what you want your legacy to be.

  • Sign

Once your documents are ready, you will review them with our team prior to signing. We do not leave our clients in the dark to interpret legal language on their own. We feel that every client should know what they are signing and how their plan works.

  • Fund

Our Client Care Coordinator provides you with detailed instructions on how to title your property and accounts to align with your plan’s objectives. From there, all that’s required of you is to sign the forms required by financial institutions.

The Consequences of Inadequate Estate Planning

Our founder Tyler R. Barrett has over a decade of experience as a thought leader in Oklahoma estate planning, writing for the Oklahoma Bar Journal and presenting continuing education courses to fellow attorneys. More importantly, and what sets Tyler apart, is that he has seen firsthand in his own family the tragic results of poor estate planning. Tyler empathizes with the fear that often grips people contemplating what might happen when they are gone.

In the absence of proper estate planning, family members may disagree on how assets should be divided.

This can lead to conflicts, strain on relationships, and an inheritance meant for one person ending up in the hands of another, such as a creditor or ex-spouse. Even when the family all agree, assets might be subject to lengthy probate proceedings. Oklahoma probate can last anywhere from 6 to 12 months. In Tyler’s case, his family unfortunately spent almost 8 years battling in court.
Not wanting other families to go through what he experienced, Tyler strives to forge a personal connection with our estate planning clients – listening reflectively to their life story, learning about their values, and understanding their concerns. By discerning what truly matters to each client, we create plans that do not simply avoid problems but rather are a solution to the problems.

Estate Planning is More Just Documents: It’s a Solution

When most people think of estate planning, their mind first turns to documents. Certainly, estate planning at its core does involve creating documents such as wills, trusts, powers of attorney, or a health care directive. Oklahoma living trusts in particular offer numerous advantages. When assets are transferred to a living trust, the successor trustee can distribute them according to the trust’s instructions, without the need for probate or court involvement. Further, living trusts provide a mechanism for managing assets if the grantor (i.e., the creator of the trust) becomes incapacitated
